Terms & Conditions

1. Definitions
1.1 “Products” means the classification mappings, crosswalk tables, correspondence tables, and other digital data files (including CSV, JSON, and XLSX formats) made available for purchase through https://classification.codes/store/selection (referred to in these Terms as the “online store” or “online order form”).
1.2 “Services” means any advisory work, consulting, or custom mapping delivered by A&K Ventures OÜ, whether purchased separately or bundled with Products.
1.3 “Products and Services” refers collectively to all offerings provided by A&K Ventures OÜ through classification.codes.
1.4 “User” or “Customer” refers to any individual, organization, or legal entity accessing, purchasing, or using our Products and Services.
1.5 “Mapping Data” refers specifically to the data contained in the Products, namely the one-to-one, one-to-many, or many-to-many correspondence tables linking industry classifications.
1.6 “Standard License” and “Extended License” are licensing models that govern the permissible use of Mapping Data, as described in Section 4.
1.7 “Agreement” refers collectively to these Terms & Conditions and all related documents incorporated by reference, including our Privacy Policy.
2. Acceptance and Changes
2.1 By accessing or using our Products and Services, you confirm that you have read, understood, and agreed to these Terms. If you are acting on behalf of an organization, you represent that you are authorized to bind that organization to this Agreement.
2.2 We may amend or update these Terms from time to time for reasons including legal compliance, product improvements, or business needs.
2.3 Changes become effective immediately when posted on classification.codes or, if applicable, when communicated by email. Material changes may be highlighted, but it remains your responsibility to review the Terms periodically.
2.4 Continued use of our Products and Services following any update constitutes acceptance of the revised Terms.
3. Permitted Use and Conduct
3.1 You agree to use our Products and Services only for lawful purposes and in compliance with this Agreement.
3.2 Prohibited conduct includes:
Gaining or attempting to gain unauthorized access to our systems.
Copying, scraping, or extracting Mapping Data without a valid license.
Uploading or transmitting viruses, malware, or malicious code.
Reselling or redistributing Mapping Data outside the terms of your license.
Using Products or Services in ways that violate applicable laws or third-party rights.
3.3 We reserve the right to monitor usage, audit compliance, and suspend or terminate access if misuse or breach of license is suspected.
3.4 You are solely responsible for the legality and appropriateness of any data or classification systems you submit to us for custom Services.
4. Licensing of Mapping Data
4.1 Standard License. Products purchased directly through our online store at https://classification.codes/store/selection are licensed under the Standard License by default. Under this license, Mapping Data may be used only internally within your organization. Redistribution, sub-licensing, public sharing, or inclusion in client deliverables is not permitted.
4.2 Extended License. If you intend to use Mapping Data externally (for example, in client projects, published research, or commercial deliverables), you must obtain an Extended License. The terms and pricing of Extended Licenses are determined on a case-by-case basis and require a written agreement with A&K Ventures OÜ or written approval from A&K Ventures OÜ before purchasing via the online order form.
4.3 Resale and Redistribution Restrictions. Neither Standard nor Extended Licenses permit resale, public redistribution, or incorporation of Mapping Data into products designed for resale, unless explicitly agreed in writing.
4.4 Audit Rights. We reserve the right to request documentation of license compliance. If you fail to demonstrate compliance, we may revoke your license, suspend delivery of Products and Services, and pursue penalties, including damages of up to €1,000,000 exclusive of VAT, in addition to legal remedies.
4.5 Survival of Restrictions. Even if your license is terminated, restrictions on redistribution, resale, and misuse remain in effect indefinitely.
5. Ordering, Payment, and Delivery
5.1 Orders must be placed exclusively through the official online order form available at https://classification.codes/store/selection. You are responsible for ensuring that all order details are accurate.
5.2 Prices are displayed exclusive of VAT unless explicitly stated otherwise. You are responsible for any applicable taxes, duties, or bank charges.
5.3 Payment must be received in full before delivery. Products are delivered electronically, typically by email, within three (3) business days after we receive and confirm full payment.
5.4 It is your responsibility to provide a valid and accessible email address. If you do not receive your Product within a reasonable time, you must notify us within 5 business days. Beyond this period, we are not obligated to re-deliver without additional charges.
5.5 Except as required by law, all sales of Products are final. Refunds are not provided except in cases of technical failure or non-delivery directly attributable to us.
5.6 Sample Requests: We provide one (1) free sample mapping of up to 10 randomly generated codes upon request. Additional samples are available at a fee of €100 (excluding VAT) per sample. Sample mappings are provided solely for evaluation purposes and are subject to the same licensing restrictions as full products.
6. Intellectual Property and Customer Data
6.1 All intellectual property rights in the website, methodologies, mapping processes, and the structure of Mapping Data are owned by A&K Ventures OÜ.
6.2 While underlying classification systems (such as NAICS, SIC, NACE, etc.) are public property owned by statistical offices or regulatory bodies, the human-made crosswalks and data products we deliver represent our intellectual property.
6.3 If you supply us with external data or classification systems for custom mapping, you warrant that you have the necessary rights to use and share such data. You grant us a limited, revocable license to process this data solely for the purpose of fulfilling your order.
6.4 Unauthorized use, reproduction, or distribution of our Products and Services may result in civil or criminal liability.
7. Disclaimers and Limitation of Liability
7.1 Products and Services are provided “as is” and “as available.” We disclaim all warranties, whether express or implied, including accuracy, fitness for a particular purpose, or non-infringement.
7.2 Although our Products are manually prepared with care, we cannot guarantee absolute freedom from errors, omissions, or misclassifications. You are responsible for verifying the suitability of Products before relying on them.
7.3 To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost opportunities, or business interruption.
7.4 Our aggregate liability under these Terms, regardless of legal theory, is capped at the total fees paid by you for Products and Services in the twelve (12) months preceding the claim.
7.5 Nothing in these Terms excludes liability for fraud, willful misconduct, or any liability that cannot legally be excluded under applicable law.
8. Indemnification
You agree to indemnify, defend, and hold harmless A&K Ventures OÜ, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal costs) arising from:
your misuse of Products or Services;
your breach of these Terms; or
your violation of third-party rights or applicable laws.
This obligation continues after termination of this Agreement.
9. Termination and Suspension
9.1 We may suspend or terminate your access to Products and Services if you breach these Terms, fail to pay, engage in fraudulent conduct, or misuse Mapping Data.
9.2 Termination may occur without notice, although we will make reasonable efforts to inform you when practical.
9.3 Upon termination, all rights to use our Products and Services cease immediately. You must delete all Mapping Data in your possession unless otherwise authorized under a separate agreement.
9.4 Clauses relating to licensing restrictions, intellectual property, indemnification, limitation of liability, and governing law survive termination.
10. Data Protection and Privacy
10.1 We process personal data in accordance with applicable laws, including the EU General Data Protection Regulation (GDPR).
10.2 Our Privacy Policy, available at classification.codes/privacy, describes how personal data is collected, processed, and protected. By using our Products and Services, you consent to this processing.
10.3 If you provide personal or sensitive data in connection with custom Services, we may require a Data Processing Agreement (DPA) to ensure compliance.
10.4 You are responsible for ensuring that your use of Products and Services complies with applicable data protection laws in your jurisdiction.
11. Governing Law and Dispute Resolution
11.1 These Terms are governed exclusively by the laws of the Republic of Estonia.
11.2 In the event of a dispute, the parties shall first attempt to resolve the matter amicably. If resolution cannot be achieved, disputes shall be referred to arbitration under the rules of the Estonian Chamber of Commerce Arbitration Court in Tartu, or otherwise to the exclusive jurisdiction of the Tartu County Court.
11.3 By using our Products and Services, you consent to this jurisdiction and venue.
12. Entire Agreement and Severability
12.1 These Terms, together with our Privacy Policy and any written agreements entered into, constitute the entire agreement between you and A&K Ventures OÜ.
12.2 If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain fully enforceable.
13. Notices
13.1 Official communications from us may be delivered via email to the address you provided when ordering, or via updates posted on classification.codes.
13.2 Notices are deemed received 24 hours after being sent or posted. You are responsible for maintaining accurate contact details.
